Welcome to Family Hive ("we", "our", or "us"). These Terms of Service ("Terms") govern your access to and use of our family management platform, AI assistant features, and all related messaging services, including our website located at https://familyhive.tools (collectively, the "Service").

By accessing, registering for, or using the Service, you are agreeing to be legally bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use our Service.

1. Eligibility and Access

Family Hive is a private, invite-only platform. To use the Service, you must be explicitly invited by an authorized administrator of a private family group. By using the Service, you represent and warrant that:

  • You are at least 13 years of age. If you are under the age of 18, you represent that you have obtained consent from your parent or legal guardian to use the Service and agree to these Terms.
  • You have been personally invited to join a private family group.
  • You will provide accurate and current information upon registration and will keep this information updated.

2. The Service

The Service is designed for personal, non-commercial, family-related use to:

  • Capture, store, and preserve family memories and stories.
  • Manage shared family tasks, events, and schedules.
  • Interact with an AI assistant ("Nesti") via text (SMS), chat, or other communication channels.

3. SMS and Messaging Terms (A2P Compliance)

Our Service uses SMS messages powered by Twilio to communicate with you. Your use of the Service constitutes your agreement to these messaging terms.

  • Consent to Receive Messages: By providing your phone number and opting in, you expressly consent to receive informational, transactional, and conversational text messages from Family Hive. These may include reminders, confirmations, notifications, and responses from our AI assistant.
  • Opt-In: You must explicitly opt-in to receive SMS messages during the registration process or through other consent mechanisms we provide.
  • Opt-Out: You can cancel the SMS service at any time. To opt-out, reply STOP, CANCEL, or UNSUBSCRIBE to any message you receive. Upon receiving your opt-out request, we will send you one final confirmation message, and you will no longer receive messages from us.
  • Help: For assistance, reply HELP to any message you receive or contact us at info@familyhive.tools.
  • Message Frequency: Message frequency will vary depending on your usage and interaction with the Service.
  • Message and Data Rates: Standard message and data rates may apply from your wireless carrier. You are solely responsible for any such charges.
  • No Sharing: We will not sell or share your phone number with third parties for marketing purposes.

4. Acceptable Use Policy

You agree not to use the Service for any unlawful, abusive, or prohibited purpose. You shall not:

  • Use the Service for any commercial purpose.
  • Share your account credentials or allow others to access your account.
  • Submit content that is illegal, defamatory, obscene, harassing, or hateful.
  • Attempt to disrupt the integrity or security of the Service, or probe, scan, or test the vulnerability of our systems.
  • Use the Service to send spam or unsolicited messages.

Violation of this policy may result in the immediate suspension or termination of your access to the Service.

5. User Content

You retain full ownership of all the text, photos, stories, and other content you submit to the Service ("User Content"). However, to operate the Service, you grant Family Hive a limited, worldwide, non-exclusive, royalty-free license to use, store, process, reproduce, and display your User Content solely for the purpose of providing and improving the Service for you and your family group.

We will not use your User Content for advertising or share it with unaffiliated third parties. You are solely responsible for the User Content you submit and for ensuring you have the rights to do so. We reserve the right, but not the obligation, to remove any User Content that violates these Terms.

6. Our Intellectual Property

All rights, title, and interest in and to the Service itself, including its software, design, branding (logos, graphics), and underlying technology (excluding User Content), are and will remain the exclusive property of Family Hive and its licensors. You may not copy, modify, or reverse engineer any part of the Service.

7. Termination

You may terminate your relationship with Family Hive at any time by ceasing all use of the Service and requesting the deletion of your account by contacting us at info@familyhive.tools.

We reserve the right to suspend or terminate your access to the Service at our discretion and without notice if you violate these Terms or misuse the platform in a way that harms the Service or its users.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FAMILY HIVE, ITS AFFILIATES, DIRECTORS, OR EMPLOYEES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE SERVICE.

10. Indemnification

You agree to defend, indemnify, and hold harmless Family Hive and its affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from your use of the Service or your violation of these Terms.

11. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of the State of Virginia, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of the Service shall be resolved exclusively in the state or federal courts located in Winchester, Virginia.

12. Modifications to Terms

We may revise these Terms from time to time. The most current version will always be posted on our website. If a revision is material, we will provide reasonable notice to our users (such as by email or an in-app notification). By continuing to use the Service after those revisions become effective, you agree to be bound by the revised Terms.
